1. Scope of Application

These Terms & Conditions apply to all agreements concluded between the client and Magical Bindery, represented by Annabell Möbius, Am Sand 34, 95466 Weidenberg, Germany.
They apply to all orders placed via magicalbindery.com as well as to bespoke commissions.


2. Subject of the Contract

Magical Bindery offers handcrafted journals, grimoires, paper boxes, and accessories such as bookmarks and charms.
I also provide bespoke services including custom-made versions of the above products and book repair — but no full restorations.


3. Offers and Contract Conclusion

All offers for products or services are non-binding.
By placing an order, the client declares a binding intention to purchase.
A contract is formed only once I confirm the order in writing via email or dispatch the goods.

For bespoke commissions and repair services, the contract is deemed concluded when I confirm the commission in writing and begin work or acquire materials required for it.
The client will be notified in writing when this occurs.


4. Use of Client Materials

Clients may provide texts, images, or other materials relevant to the commission.
Such materials will be used solely for the execution of the commission and will not be copied, redistributed, or used for any other purpose without explicit permission.
All intellectual property rights remain with the client.


5. Copyright and Client Responsibility

The client is solely responsible for ensuring that any material they provide may be lawfully used and does not infringe upon third-party rights. Magical Bindery is not obliged to verify the legality of such materials.
The client confirms that they possess all necessary usage rights, including but not limited to copyright, trademark, or other intellectual property rights.


6. Ownership and Use of Product Images

All product photographs taken by Magical Bindery — including those of bespoke works — remain my exclusive property.
Clients may share images of their purchased items on social media, provided proper credit is given: Annabell Möbius / Magical Bindery.


7. Prices and Payment Terms

All prices are stated in Euros and are exempt from VAT according to §19 of the German VAT Act (small business regulation).

Invoices are due within 14 days without deduction.
Bank details will be provided in the order confirmation.

In the event of late payment, Magical Bindery may charge reminder fees and statutory default interest.
Persistent non-payment may result in further legal action.

For bespoke commissions, Magical Bindery reserves the right to adjust the originally estimated price if justified changes occur (e.g., different materials, altered design, significantly increased labour).
Any such changes will be communicated to the client.


8. Delivery Conditions

Finished items are dispatched within approx. 5 working days after payment has been received.
Delivery times for bespoke commissions are agreed individually and communicated before the contract is concluded.

Shipping costs are borne by the client unless otherwise agreed.


9. Cancellation & Refunds

The client may withdraw from the purchase of ready-made items within 14 days of receipt and return the item in its original condition.
The client bears the return postage and is liable for any damage during return transit.
Refunds are issued within 14 days after the returned item has been inspected.

Exclusion:
No right of withdrawal exists for bespoke items made to customer specification or clearly personalised, according to §312g (2) No.1 BGB.

Commissioned services (custom work & repairs):
The client may cancel as long as I have not yet begun work or ordered materials.
I normally inform the client one day before work begins.


10. Nature of Handmade Items

All works are handcrafted; each piece is unique.
Minor irregularities are not defects but evidence of human craftsmanship.
I take great care to work precisely, yet slight imperfections may occur.


11. Voluntary Warranty

In addition to statutory rights, I offer a voluntary two-year warranty on the binding structure (connection between book block and cover) for normal use — including daily carrying and writing.

This warranty does not cover damage caused by fire, water, misuse, deliberate force, or natural wear of the cover.


12. Communication for Services

Magical Bindery may use WhatsApp for commission-related communication if the client agrees.
Use of WhatsApp is voluntary and carries inherent data protection risks, as WhatsApp is an external platform beyond my control.

Clients may always choose email as an alternative.


13. Packaging & Environmental Considerations

Shipments are packaged using reused materials whenever possible, including recycled cardboard and occasionally recycled bubble wrap.
This reduces waste and environmental impact.


14. Material Quality

Materials are sourced from various suppliers.
I select and test them to the best of my knowledge but cannot be held liable for defects originating from the materials themselves.

Natural materials may vary in colour, texture, and ageing behaviour; such variations are part of their character.

Self-made materials are clearly identified in the product description.


15. Liability and Statutory Warranty

I am liable for defects in accordance with statutory German law.
Clients may request repair or replacement.
If rectification fails, clients may withdraw from the contract or request a price reduction.

Liability for damages is limited to intent and gross negligence.
For slight negligence, liability applies only to essential contractual obligations and only up to the typically foreseeable damage.


16. Data Protection

I treat all personal data confidentially and process it only as necessary for fulfilling the contract or responding to enquiries.
Data is shared only with service providers essential for the contract (e.g., postal carriers).

Data is retained as required by statutory retention periods and then deleted.
Clients retain full rights to access, correction, deletion, restriction, and data portability.

17. Final Provisions

German law applies.
Place of jurisdiction is Bayreuth, Germany.

Should any clause be invalid, the remaining provisions remain unaffected.
